Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of Atiro’s website and services (“Services”), provided by Atiro (“Atiro,” “we,” “us”). By using the Services, you agree to these Terms. If you’re using the Services on behalf of a business, you agree on its behalf and confirm you’re authorized to do so.
The service
Atiro provides marketing services delivered by a team of named AI specialists supported by human experts. Our AI specialists are disclosed as AI in every channel; we don’t present AI work as human work.
Work we produce for you — pages, posts, and profile changes — is placed in a sign-off queue and published only after you approve it. Our free audit is an informational assessment, not a guarantee of results.
Accounts and eligibility
You must provide accurate information when requesting an audit or creating an account, and keep your account credentials secure. You’re responsible for activity under your account. You must be at least 18 and able to form a binding contract to use the Services.
Plans, billing, and cancellation
Paid plans are billed monthly in advance and described at the point of purchase. There is no long-term contract — plans are month to month and you can cancel anytime, effective at the end of the current billing period. Fees are non-refundable except where required by law.
Website builds, when purchased, carry a one-time fee quoted at your audit based on scope; ongoing maintenance is included with an active monthly plan. Prices and taxes are shown before you commit.
Your content and ownership
You retain ownership of your business information, brand assets, domain, and — for website customers — the website and its content. If you leave Atiro, your assets stay yours.
You grant us the rights needed to perform the Services (for example, to manage your profiles, publish approved work, and install tracking). You’re responsible for having the rights to any materials you provide, and for approving work before it goes live.
Acceptable use
You agree not to:
- use the Services for unlawful, deceptive, or infringing purposes;
- misrepresent your business or provide false information;
- interfere with or disrupt the Services or attempt to access them without authorization; or
- reverse engineer or resell the Services except as permitted by law.
Intellectual property
The Atiro name, logo, specialist marks, and the software and content we create for the Services (excluding your content) are owned by Atiro or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services while your account is active.
Disclaimers
The Services are provided “as is” and “as available.” Marketing outcomes depend on many factors outside our control, and we don’t guarantee specific rankings, call volumes, or revenue. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Atiro will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold Atiro harmless from claims, damages, and expenses arising out of your content, your use of the Services, or your violation of these Terms or applicable law.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or use the Services in a way that risks harm to others. On termination, your right to use the Services ends; provisions that by their nature should survive (such as ownership, disclaimers, and liability limits) will survive.
Governing law and disputes
These Terms are governed by the laws of [governing jurisdiction], without regard to conflict-of-laws rules. The parties agree to the exclusive jurisdiction of the courts located in [venue] for any disputes not subject to other dispute-resolution terms.
